BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. Violence is a known risk factor for health problems. In this epidemiological study across 5,385 male patients, we investigate the prevalence of perpetrated violence, exposure to violence, their overlap and the relationship between violence, mental, and psychosomatic health, as well as adverse health behaviors, such as self-harming behavior and the consumption of drugs. Participants completed an anonymous questionnaire addressing violence experience, age of victimization/perpetration, frequency, and perceived severity of violence exposure. We considered physical, psychological as well as sexual violence. Information (...) on health status and adverse health behaviors complemented the data. Results showed that 48.4% of the sample reported having experienced violence. The victim-perpetrator overlap formed the largest group, in which the incidence of having experienced multiple types of violence was significantly higher compared to victims and perpetrators. The age-crime curve flattened more slowly with increasing age in this group. Although the perceived severity of exposure to violence is lower in the overlap group, its health status and adverse health behaviors were worse. Interventions should focus on this group since they constitute a burden for the healthcare system. (shrink)

Are there any prima facie reasons that democracies might have for disenfranchising older citizens? This question reflects increasingly salient, but often incompletely theorized complaints that members of democratic publics advance about older citizens’ electoral influence. Rather than rejecting these complaints out of hand, we explore whether, suitably reconstructed, they withstand democratic scrutiny. More specifically, we examine whether the account of political equality that seems to most fittingly capture the logic of these complaints – namely, equal opportunity of political influence over (...) electoral outcomes – can justify disenfranchising older citizens. We conclude that equal opportunity of influence cannot ground a blanket disenfranchisement of older people and that, taken in conjunction with other general considerations that apply to all sound electoral policies, partial disenfranchisement proposals (i.e. proposals for reducing the electoral influence of older citizens via age-weighted voting) are both quasi-inapplicable and practically unrobust across a relevant range of political contexts. The goal of this paper is to present a collection of properties of the set of atoms and the set of finite injective tuples of atoms, as well as of the powersets of atoms in the framework of finitely supported structures. Some properties of atoms are obtained by translating classical Zermelo–Fraenkel results into the new framework, but several important properties are specific to finitely supported structures.

The goal of this paper is to define and study the notion of infinity in the framework of finitely supported structures, presenting new properties of infinite cardinalities. Some of these properties are extended from the non-atomic Zermelo–Fraenkel set theory to the world of atomic objects with finite support, while other properties are specific to finitely supported structures. We compare alternative definitions for infinity in the world of finitely supported sets, and provide relevant examples of atomic sets which satisfy some forms (...) of infinity, while do not satisfy others. Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

In an increasingly urbanized world, construction industry is called upon to serve the needs of human society, such as environmental protection and safety in terms of infrastructure. In this context, a sustainable and ethical development means a close connection between buildings and environment. This connection can be achieved through, for example, the concept of ecological concrete or green concrete, as it is often called. The conventional process of obtaining cement and mineral aggregates from the concrete composition generates pollution, especially through (...) greenhouse gas emissions. Also, one should not ignore the fact that extraction of the raw materials affects the habitats of the sites and of the neighboring areas. When construction materials are questioned, the ethical issues lay not in the means of expression, but mainly in the means of production. More to the point, the present contribution aimed to find solutions for enhancing the adhesion of vegetal aggregates with the cement matrix, in order to obtain a material with optimal mechanical properties, which is valued as an ethical approach of building industry. Results showed that plant aggregates can be used to obtain a building material which can be improved by using partial substitution of cement by silica fume, fly ash, or by using additives and that green concrete as an environmentally friendly material offers the alternative for lower energy use and fewer CO2 emissions. Marketers must understand not only the advantages of these green materials, but also that they have an ethical commitment to provide consumers with environmentally friendly materials. (shrink)

This article relates two forms of political and cultural marginality and emancipation to a third one, which, in traditional patriarchal cultures, is the embodiment of marginality par excellence: that of the female self. It explores their similar positioning in the spatial and temporal economy of power relations in a detailed analysis of Irina Grigorescu Pana's novel Melbourne Sundays, a fictionallyrical account of the Romanian author's 11-year exile in Australia, read as a narrative counterpart of her critical approach to exile (...) in The Tomis Complex: Exile and Eros in Australian Literature. These two works describe an experience happening at the intersection between the author's national background – that of Romania – and the postcolonial one of her country of adoption – Australia – as they become relevant from her personal and professional experience as a woman writer. Exile is thus reflected in language, being spatially constructed by means of metaphors such as book, theatre, carnival, garden, which are also relevant for the process of identity formation. The argument mainly relies on Kristeva's theories, an approach motivated by Pana's own choice of the Kristevan discourse of love/hate in relation to the theme of exile in her fictional and critical works, since, as she remarks, exiles and lovers share a marginal, though at the same time essential, position in postcolonial cultures. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” (...) its compelling presence “across fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). Cancers rely on multiple, heterogeneous processes at different scales, pertaining to many biomedical fields. Therefore, understanding cancer is necessarily an interdisciplinary task that requires placing specialised experimental and clinical research into a broader conceptual, theoretical, and methodological framework. Without such a framework, oncology will collect piecemeal results, with scant dialogue between the different scientific communities studying cancer. We argue that one important way forward in service of a more successful dialogue is through greater integration of applied sciences (experimental and clinical) (...) with conceptual and theoretical approaches, informed by philosophical methods. By way of illustration, we explore six central themes: (i) the role of mutations in cancer; (ii) the clonal evolution of cancer cells; (iii) the relationship between cancer and multicellularity; (iv) the tumour microenvironment; (v) the immune system; and (vi) stem cells. In each case, we examine open questions in the scientific literature through a philosophical methodology and show the benefit of such a synergy for the scientific and medical understanding of cancer. This study evaluated how gender is related to children’s intelligence beliefs, goal orientations and academic achievement and whether there are gender differences in how intelligence beliefs and goal orientations are related to academic achievement. The participants, 362 seventh grade students, completed measures regarding their intelligence beliefs and goal orientations at the beginning of the second semester and the grades were collected at the end of the semester. Girls reported higher scores on incremental belief, mastery goal and higher achievement but lower (...) levels of performance avoidance compared to boys. The relations between intelligence beliefs and academic achievement were fully mediated by both performance goals. Further, there were no gender differences in the associations among intelligence beliefs, goal orientations and achievement. We present a logical calculus for reasoning about information flow in quantum programs. In particular we introduce a dynamic logic that is capable of dealing with quantum measurements, unitary evolutions and entanglements in compound quantum systems. We give a syntax and a relational semantics in which we abstract away from phases and probabilities. We present a sound proof system for this logic, and we show how to characterize by logical means various forms of entanglement (e.g. the Bell states) and various (...) linear operators. Collaborative forms of work such as extended networks, expert groups, and consortia increasingly structure biomedical activities. They are particularly prominent in the cancer field, where procedures such as multicenter clinical trials have been instrumental in establishing the specialty of oncology, and subfields such as cancer genetics, where bioclinical activities—for example, testing for breast and ovarian cancer genes and follow-up interventions—are predicated on the articulation of a number of tasks performed by new clinical collectives. In this article, we examine the founding (...) and development of a French bioclinical collective—the Groupe Génétique et Cancer —that coordinates and structures the activities of most French actors in cancer genetics and operates simultaneously in the clinical, research, and regulatory domains. We establish that the isomorphism problem for the classes of computable nilpotent rings, distributive lattices, nilpotent groups, and nilpotent semigroups is \-complete, which is as complicated as possible. The method we use is based on uniform effective interpretations of computable binary relations into computable structures from the corresponding algebraic classes.

In this paper, I propose a new way to distinguish between indexicals, like “I” and “today”, and demonstratives, like “she” and “this”. The main test case is the second person singular pronoun “you”. The tradition would generally count it as a demonstrative, because the speaker’s intentions play a role in providing it with a semantic value. I present cross-linguistic data and explanations offered of the data in typology and semantics to show that “you” belongs on the indexical side, and argue (...) that they can be generalized to a novel criterion for distinguishing between indexicals and demonstratives. The central theoretical claim is that the semantic values of indexicals are objects which play certain utterance-related roles, which are fixed independently of the words being used in the utterance. For instance, the speaker plays the speaker role whether or not she uses the word “I”, and the addressee plays that role whether or not the speaker uses the word “you”. Demonstratives, on the other hand, pick out objects that play no such role, and are instead helped by the speaker’s word-specific intentions. (shrink)

We address the old question whether a logical understanding of Quantum Mechanics requires abandoning some of the principles of classical logic. Against Putnam and others (Among whom we may count or not E. W. Beth, depending on how we interpret some of his statements), our answer is a clear "no". Philosophically, our argument is based on combining a formal semantic approach, in the spirit of E. W. Beth's proposal of applying Tarski's semantical methods to the analysis of physical theories, with (...) an empirical-experimental approach to Logic, as advocated by both Beth and Putnam, but understood by us in the view of the operationalrealistic tradition of Jauch and Piron, i. e. as an investigation of "the logic of yes-no experiments" (or "questions"). Technically, we use the recently-developed setting of Quantum Dynamic Logic (Baltag and Smets 2005, 2008) to make explicit the operational meaning of quantum-mechanical concepts in our formal semantics. Based on our recent results (Baltag and Smets 2005), we show that the correct interpretation of quantum-logical connectives is dynamical, rather than purely propositional. We conclude that there is no contradiction between classical logic and (our dynamic reinterpretation of) quantum logic. Moreover, we argue that the Dynamic-Logical perspective leads to a better and deeper understanding of the "non-classicality" of quantum behavior than any perspective based on static Propositional Logic. This paper presents a simple decidable logic of functional dependence LFD, based on an extension of classical propositional logic with dependence atoms plus dependence quantifiers treated as modalities, within the setting of generalized assignment semantics for first order logic. The expressive strength, complete proof calculus and meta-properties of LFD are explored. Various language extensions are presented as well, up to undecidable modal-style logics for independence and dynamic logics of changing dependence models. Finally, more concrete settings for dependence are discussed: continuous (...) dependence in topological models, linear dependence in vector spaces, and temporal dependence in dynamical systems and games. In this paper we aim to examine a novel view on distributive justice, i.e. limitarianism, which claims that it is morally impermissible to be rich. Our main goal is to assess the two arguments provided by Ingrid Robeyns in favour of limitarianism, namely the democratic argument and the argument from unmet urgent needs and the two distinct limitarian views which these arguments give rise to. We claim that strong limitarianism, which is supported by the democratic argument, should be rejected as (...) it fails to fully instantiate the value of political equality, while having some other unattractive implications as well. By contrast, we argue that weak limitarianism, which is supported by the argument from unmet urgent needs, should be endorsed, albeit in a qualified version which also takes responsibility constraints into consideration. The past decade or so has witnessed an increase in the number of philosophical discussions about emergence and reduction in science. However, many of these discussions (though not all) remain too abstract and theoretical, and are wanting with respect to concrete examples taken from the sciences. This dissertation studies the topics of reduction and emergence in the context of a case study. I focus on the case of chemistry and investigate how emergentism can help us secure the autonomy of this (...) discipline in relation to the underlying microphysics. I develop an account of emergence (called functional emergence) that is, I argue, capable of answering the question of why we have chemistry instead of just applied quantum mechanics. I argue that functionally emergent properties in chemistry -- properties that are defined by their behaviour, not by some shared microphysical constituent -- can help us defend the autonomy of chemistry; they allow for the existence of sui generis chemical regularities, which can be used in sui generis chemical explanations. Functional emergence generates difficulties for some accounts of inter-theoretic reduction, but unlike other theories of emergence it is compatible with weaker forms of reductionism. (shrink)

In this article I aim to offer a first critical assessment of the most prominent arguments in favour of restricting the voting rights of senior citizens. The first argument discussed, most thoroughly articulated by van Parijs, maintains that intergenerational justice would be improved under schemes which restrict the voting rights of senior citizens, thereby diminishing their overall electoral weight. The second argument, reconstructed from Lau's defence of child enfranchisement, maintains that the cognitive decline associated with the process of aging should (...) lead us to treat children and senior citizens identically in respect to electoral rights; thus, if we agree that children should not have the right to vote, consistency dictates that senior citizens should be disenfranchised as well. I respond to these arguments with several objections, arguing that the former relies on a number of faulty empirical premises and has deeply unattractive implications for enfranchisement once consistently applied, and that the latter fails to make empirically salient distinctions between children and senior citizens when it comes to the political domain. We investigate the discrete (finite) case of the Popper–Renyi theory of conditional probability, introducing discrete conditional probabilistic models for knowledge and conditional belief, and comparing them with the more standard plausibility models. We also consider a related notion, that of safe belief, which is a weak (non-negatively introspective) type of “knowledge”. We develop a probabilistic version of this concept (“degree of safety”) and we analyze its role in games. We completely axiomatize the logic of conditional belief, knowledge and safe belief (...) over conditional probabilistic models. We develop a theory of probabilistic dynamic belief revision, introducing probabilistic “action models” and proposing a notion of probabilistic update product, that comes together with appropriate reduction laws. The paper intends to study the possibility of evading the relativist dilemma: when you compare cultural forms belonging to different traditions, you either impose the result from outside, or you give up comparisons altogether as dependent on the arbiter’s parochial choices. In this paper one argues that, apart from this kind of comparison, which is called extrinsic, there is another type, called intrinsic, which is not dependent on arbiter’s choices. The essence of the intrinsic comparison is the role played by (...) the “second option” of the representatives of different traditions: it is decisive what these representatives prefer in the second place, when their first options have to be abandoned. Two old stories provide the historical paradigm of the intrinsic comparison: how Volga Khazarians are said to have converted to Judaism in the 8th century, and how the Athenian general Themistocles was voted the best general by the confederate Greek representatives. An example of contemporary intrinsic comparison between three contemporary trends – relativism, fundamentalism, rationalism – is also presented. Contrary to what Ernest Gellner believes, these trends are not incommensurable; rationalism takes precedence while being the second option of the other two trends, as soon as they want to enter a public debate. Since Kaplan : 81–98, 1979) first provided a logic for context-sensitive expressions, it has been thought that the only way to construct a logic for indexicals is to restrict it to arguments which take place in a single context— that is, instantaneous arguments, uttered by a single speaker, in a single place, etc. In this paper, I propose a logic which does away with these restrictions, and thus places arguments where they belong, in real world conversations. The central innovation is (...) that validity depends not just on the sentences in the argument, but also on certain abstract relations between contexts. This enrichment of the notion of logical form leads to some seemingly counter-intuitive results: a sequence of sentences may make up a valid argument in one sequence of contexts, and an invalid one in another such sequence. I argue that this is an unavoidable result of context sensitivity in general, and of the nature of indexicals in particular, and that reflection on such examples will lead us to a better understanding of the idea of applying logic to context sensitive expressions, and thus to natural language in general. We present a complete, decidable logic for reasoning about a notion of completely trustworthy evidence and its relations to justifiable belief and knowledge, as well as to their explicit justifications. This logic makes use of a number of evidence-related notions such as availability, admissibility, and “goodness” of a piece of evidence, and is based on an innovative modification of the Fitting semantics for Artemovʼs Justification Logic designed to preempt Gettier-type counterexamples. We combine this with ideas from belief revision and awareness (...) logics to provide an account for explicitly justified knowledge based on conclusive evidence that addresses the problem of omniscience. In this paper, we investigate the social herding phenomenon known as informational cascades, in which sequential inter-agent communication might lead to epistemic failures at group level, despite availability of information that should be sufficient to track the truth. We model an example of a cascade, and check the correctness of the individual reasoning of each agent involved, using two alternative logical settings: an existing probabilistic dynamic epistemic logic, and our own novel logic for counting evidence. Based on this analysis, we (...) conclude that cascades are not only likely to occur but are sometimes unavoidable by "rational" means: in some situations, the group’s inability to track the truth is the direct consequence of each agent’s rational attempt at individual truth-tracking. Moreover, our analysis shows that this is even so when rationality includes unbounded higher-order reasoning powers, as well as when it includes simpler, non-Bayesian forms of heuristic reasoning. Dreams are a complex phenomenon which the philosophical field knows very little about. However, scientists like Freud or Jung, were able to prove that dream interpretation brings different advantages to our lives. For that reason, the purpose of this paper is to demonstrate that dreams, when understood, can offer us a new life perspective, especially in difficult times. Therefore, with the help of an innovative phenomenological approach introduced by Maria Zambrano, which focuses on the form of the dream and its (...) relation with time perception, rather than the dream content, we are going to observe that people have many types of consciousness, as well as different forms of access to time which relate to multiple perception modes and emotional states. Applying this theory, Maria J. Neves, is able to demonstrate that a phenomenological dream analysis can produce significant changes in peoples’ lives. (shrink)

We propose a refinement of STIT logic to make it suitable to model causal agency and responsibility in basic multi-agent scenarios in which agents can interfere with one another. We do this by supplementing STIT semantics, first, with action types and, second, with a relation of opposing between action types. We exploit these novel elements to represent a test for potential causation, based on an intuitive notion of expected result of an action, and two tests for actual causation from the (...) legal literature, i.e. the but-for and the NESS tests. We then introduce three new STIT operators modeling corresponding notions of causal responsibility, which we call potential, strong, and plain responsibility, and use them to provide a fine-grained analysis of a number of case studies involving both individual agents and groups. We propose a new model for forming and revising beliefs about unknown probabilities. To go beyond what is known with certainty and represent the agent’s beliefs about probability, we consider a plausibility map, associating to each possible distribution a plausibility ranking. Beliefs are defined as in Belief Revision Theory, in terms of truth in the most plausible worlds. We consider two forms of conditioning or belief update, corresponding to the acquisition of two types of information: learning observable evidence obtained by (...) repeated sampling from the unknown distribution; and learning higher-order information about the distribution. The first changes only the plausibility map, but leaves the given set of possible distributions essentially unchanged; the second rules out some distributions, thus shrinking the set of possibilities, without changing their plausibility ordering.. We look at stability of beliefs under either of these types of learning, defining two related notions, as well as a measure of the verisimilitude of a given plausibility model. We prove a number of convergence results, showing how our agent’s beliefs track the true probability after repeated sampling, and how she eventually gains in a sense knowledge of that true probability. Finally, we sketch the contours of a dynamic doxastic logic for statistical learning. (shrink)

We construct logical languages which allow one to represent a variety of possible types of changes affecting the information states of agents in a multi-agent setting. We formalize these changes by defining a notion of epistemic program. The languages are two-sorted sets that contain not only sentences but also actions or programs. This is as in dynamic logic, and indeed our languages are not significantly more complicated than dynamic logics. But the semantics is more complicated. In general, the semantics of (...) an epistemic program is what we call aprogram model. This is a Kripke model of ‘actions’,representing the agents' uncertainty about the current action in a similar way that Kripke models of ‘states’ are commonly used in epistemic logic to represent the agents' uncertainty about the current state of the system. Program models induce changes affecting agents' information, which we represent as changes of the state model, called epistemic updates. Formally, an update consists of two operations: the first is called the update map, and it takes every state model to another state model, called the updated model; the second gives, for each input state model, a transition relation between the states of that model and the states of the updated model. Each variety of epistemic actions, such as public announcements or completely private announcements to groups, gives what we call an action signature, and then each family of action signatures gives a logical language. The construction of these languages is the main topic of this paper. We also mention the systems that capture the valid sentences of our logics. But we defer to a separate paper the completeness proof. (shrink)

In Philosophy of Law, Andrei Marmor provides a comprehensive analysis of contemporary debates about the fundamental nature of law—an issue that has been at the heart of legal philosophy for centuries.
